You acknowledge that this payment may not avoid collection activity on your account. If your services have been canceled for non payment, please contact Student Movement Customer Care today. If Student Movement incurs fees for issues with your payment, your account will be charged an additional $30 to cover Student Movement’s time and expense.
By accepting this transaction, your payment will be processed immediately. Please allow 1 2 business days for the payment to show on your Student Movement online account. You will receive a notification that your payment has been accepted. Student Movement does not charge you for making a one time payment online at this time, however, you should check with your bank for any additional charges.
You agree to notify Student Movement immediately if your email address, credit card, debit card or bank account information changes or the security of your Username or Password is compromised at any time. You acknowledge that the origination of these charges to your Student Movement Account must comply with U.S. law. You release Student Movement Inc. from any and all claims arising from this one time Payment. All charges, terms and conditions are subject to change. These Terms and Conditions may be modified or amended by Student Movement at any time without notice.
You agree to pay the full amount for a semester pass unless you live in the contracted apartment complexes where the promotion code applies or an authorized sales representative of Student Movement Inc. releases a code directly to you.
Student Movement has been authorized by Brigham Young University (“BYU”) to drive Student Movement buses on BYU property to pick up and drop off student passengers. BYU and Student Movement are not affiliated in any way as partners, owners or joint venturers. BYU has no interests in Student Movement and is not liable for any actions or contractual obligations of Student Movement.
The pass to ride the buses shall be your BYU activity card. The card will be scanned to ride the bus. You agree that your BYU activity number will be used to identify you as an authorized rider. Your activity card will only be used to identify you as an authorized passenger of Student Movement and it will be used for no other purposes. If you allow another person to use your activity card to ride the bus, you will forfeit your right to ride the bus.
When boarding, you must have your activity card ready for scanning. If Student Movement determines to charge for Saturday grocery/shopping runs you must have exact fare change ready as the operator cannot make change. Your paid pass covers weekday bus service for days BYU classes are scheduled. Unless otherwise determined by Student Movement, bus service shall correlate directly with the BYU school schedule and will not run on holidays set forth in BYU’s schedule. Upon the expiration of the term of your pass, your right to ride the bus expires until you purchase another pass. Student Movement reserves the right to make a separate charge per ride for Saturday service if it deems that to be necessary.
You acknowledge that passengers board the bus on a first-come-first-served basis. Once the bus space is full (as determined by the operator) passengers not on board must wait for the next available bus. Because buses are more crowded at certain times of the day, it is recommended that passengers plan accordingly. Student Movement shall not be liable for delays resulting from passengers not being able to board, from mechanical failure of the bus, from delays in bus schedules, or from the effects of accidents, traffic, weather, or other circumstances outside the reasonable control of Student Movement.
Student Movement will make reasonable efforts to maintain the services as advertised by it but it reserves the right to alter, suspend or withdraw any vehicle or service without notice if such delay is caused as a consequence of matters outside of its control, such as adverse weather conditions, vehicle failure, road congestion, road works or traffic diversions. Student Movement shall not be responsible for any loss or damage you incur caused as a consequence of delay or cancellation.
You must always use caution when boarding and exiting the buses. When the bus pulls up to a stop, remain seated until the bus comes to a complete stop. Allow passengers to exit the bus before you board. Show courtesy to other passengers boarding and exiting the buses. Use caution around traffic and obey all rules applicable to pedestrians when outside the buses. Once you have exited the bus, never cross directly in front of it. Wait until the bus leaves the stop before crossing its path.
If you are injured or sustain any other loss while riding the bus or if you have a complaint concerning the bus service, you are to notify the operator immediately and file an incident report with Student Movement as soon as possible, but no later than 72 hours.
Do not distract the operator and stay behind the yellow line while the bus is in motion. Stay clear of doorways and stairwells. Permitted standing passengers must hold onto poles, railings or any straps provided, while the bus is in motion. Obey all instructions given by the bus operator or by Student Movement representatives.
At no time shall any person falsely impersonate a Student Movement employee or representative.
Yield the seats in front of the bus for senior and disabled customers. Service animals are welcome and ride free of charge. No other animals are allowed on the buses. Wheelchair and bicycle rack capacity is limited to that shown on each bus. Student Movement cannot guarantee that a wheelchair or bicycle can be carried on any specific run.
Use courtesy while riding the bus. Use electronic devices, such as mp3 players, smart phones, laptops, and the like, with headphones so the sound is not audible to others. When using cell phones speak softly. Refrain from using obscene, vulgar or offensive language and pushing, shouting or other disruptive behavior. Obscene or vulgar attire is prohibited. Shoes or other footwear are required to be worn. Shirts are required to be worn.
No feet on the seats. Heads, arms, and other body parts must be kept inside the bus. No person shall hang on or in any manner attach themselves to any exterior part of the bus, regardless of whether the bus is in motion.
No person shall knowingly throw or discard an object at or from a bus.
Refrain from eating or drinking on the bus and have all drinks and food contained in spill-proof containers. No littering.
Smoking, drinking alcohol and/or the use of illegal drugs are prohibited. No person shall enter or remain in or upon a Student Movement bus while under the influence of a alcohol or a controlled substance.
No person shall destroy, deface, mutilate, damage or otherwise tamper with a Student Movement bus, or any part thereof, including, but not limited to, any sign, signal, notice, or advertisement located in or upon a Student Movement Bus or otherwise posted by Student Movement.
Individuals who are infected or believe that they may be infected with a communicable disease who pose a threat to the public health and who do not take action as required by the Department of Health to prevent spread of the disease shall not board the bus. Individuals with a communicable disease who are subject to an order of restriction issued by the Department of Health shall not board the bus.
No unauthorized person shall make any solicitations on the bus or place, permit, or cause to be placed any notice or advertisement in or on the bus.
While in or upon a Student Movement bus, no person shall use, access, or otherwise utilize Student Movement’s Internet or electronic network services for the purpose of viewing, displaying, or accessing any “inappropriate websites.” For purposes of this paragraph, “inappropriate websites” include, but are not limited to, pornographic, adults-only, gambling, or gaming sites. Additionally, any person who uses, accesses, or otherwise utilizes Student Movement’s Internet or electronic network services agrees, as a condition of such use, access, or utilization, that Student Movement is not liable or responsible for any lost data, interrupted connectivity, or breaches of confidentiality.
You must not bring on board the bus certain restricted items, including skateboards, scooters and skates (unless placed in a bag or container with wheels covered), or any object too large to fit between passenger seats. Keep the aisle clear of backpacks, briefcases, grocery bags or other packages.
Federal regulations prohibit the transportation of flammable or explosive materials on transit vehicles. This includes automobile batteries. Electric mobility device battery packs and portable oxygen tanks are exempt from this requirement. Student Movement reserves the right to refuse any unsuitable or awkward packages or an excessive amount of packages or carry-on items.
You are responsible for packages and other belongings you bring on a bus and Student Movement shall have no liability for lost or damaged items. Any person who finds property accidentally left in a bus shall immediately turn it in to the operator or other Student Movement representative. Passengers who have lost property should contact Student Movement to make application for recovery. Student Movement representatives shall be authorized to open packages, bags or other containers to identify the owner and assess the contents. Perishable goods will not be kept more than 48 hours from the time when they were found. Any property which is or becomes objectionable will be destroyed or otherwise disposed of.
By your use of the Student Movement website (the “Site”) or accessing any materials on the Site, you agree to these Terms and Conditions, as they may be updated or modified by Student Movement at any time in its discretion. If you do not agree to them, you may not use the Site or download any material from it.
The Site is intended for Student Movement to provide information relating to its services, programs, objectives, missions and projects to the public and its customers. All decisions as to the placement of links to external sites or pages from the Site will be made by Student Movement in its sole discretion.
SMI reserves the right at any time and from time to time to modify or discontinue the Site (or any part thereof), temporarily or permanently, with or without notice. You agree that Student Movement will not be liable to you for any modification, suspension or discontinuance of the Site.
You agree that Student Movement, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Site, and remove and discard any content within the Site, for any reason, including, without limitation, our belief that you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions. You agree that any termination of your access to the Site under any provision of these Terms and Conditions may occur without prior notice to you, and you also agree that Student Movement will not be liable to you for any termination of your access to the Site.
All materials published on the Site, including, but not limited to, trademarks, service marks, maps, schedules, arrival and departure information, fare information, photographs and illustrations (collectively, the “Content”), are the property of Student Movement unless otherwise indicated. Third-party trademarks are the property of their respective owners. You may use the Content displayed on the Site for personal, non-commercial use only, provided that you do not remove any trademarks, copyright or any other notice contained in such content. Any other use, including reproduction, modification, distribution, transmission, republication, display or performance, is strictly prohibited without the express written consent of Student Movement.
All Content of this Site is the property of Student Movement or its content suppliers, and is protected by United States and international copyright laws. The compilation of the Content on this Site is the exclusive property of Student Movement, and is likewise protected by United States and international copyright laws. The Student Movement trademarks may not be used in connection with the products or services of others, except for the use of a text link or a Student Movement web logo to link to this Site, in accordance with these Terms and Conditions and Student Movement’s linking policy. All other trademarks not owned by Student Movement that appear on this Site are the property of their respective owners.
YOU AGREE THAT STUDENT MOVEMENT’S SERVICE AND THE INFORMATION ON THE SITE ARE PROVIDED TO YOU AS IS AND AS AVAILABLE WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. Student Movement does not warrant that the Site will be available at any given time, secure, accurate or free of error. You use the Site at your own risk, and you assume the risk that the Site may provide incorrect information to you, as well as the risk that any material downloaded by you from the Site may cause loss of data or damage to your computer system.
YOU UNDERSTAND AND AGREE THAT IN NO EVENT WILL STUDENT MOVEMENT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, EVEN IF STUDENT MOVEMENT IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS OR FOR ANY OTHER SPECIAL, CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES, HOWEVER CAUSED, WHETHER BASED UPON CONTRACT, NEGLIGENCE, STRICT LIABILITY IN TORT, WARRANTY, OR ANY OTHER LEGAL THEORY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. THE PARTIES INTEND THAT THIS LIMITATION SHOULD APPLY EVEN IF IT CAUSES ANY WARRANTY TO FAIL OF ITS ESSENTIAL PURPOSE.
You agree to indemnify, defend and hold harmless Student Movement and its employees from and against all fines, suits, proceedings, claims, causes of action, damages, demands, or liabilities of any kind or of any nature, including reasonable attorneys’ fees incurred, arising out of or in connection with your use of the Site.
The invalidity of any term or provision of these Terms and Conditions will not affect the validity of any other provision. Waiver by Student Movement of strict performances of any provision of these Terms will not be a waiver of or prejudice Student Movement’s right to require strict performance of the same provision in the future or of any other provision of these Terms and Conditions.
These Terms and Conditions constitute the entire agreement between the parties as to the subject matter, and there are no other terms, conditions or obligations between the parties relating to Student Movement’s services or the use of the Site, other than those contained in these Terms and Conditions.
Any passenger who breaches any of these Terms and Conditions will be subject to forfeiting the right to ride the bus without refund of amounts paid. Student Movement reserves the right to pursue any and all additional remedies against any passenger violating these Terms and Conditions.
